GDPR covers a broad spectrum of information that could be used on its own, or in combination with other pieces of information, to identify a person. Individual Data Subject's Rights - Data Access, Portability and Deletion We are committed to helping our customers meet the data subject rights requirements of GDPR. vrouyr processes or stores all personal data in fully vetted, DPA compliant vendors. We do store all conversation and personal data for up to 6 years unless your account is deleted. In which case, we dispose of all data in accordance with our Terms of Service and Privacy Policy, but we will not hold it longer than 60 days.

Artikel 1: Algemene bepalingen
De website met webshop van de verkoper (hierna “Vrouyr”) biedt aan kopers (hierna “Klanten”) de mogelijkheid om de producten uit haar webshop online aan te kopen. Onderhavige algemene voorwaarden regelen de relatie tussen Vrouyr en de Klant in geval van bestellingen via diens webshop.

Bij het plaatsen van een bestelling via de webshop van Vrouyr moet de Klant deze algemene voorwaarden uitdrukkelijk aanvaarden. Bij aanvaarding stemt de Klant in met de toepasselijkheid van deze algemene voorwaarden, met uitsluiting van alle andere contractvoorwaarden.

De toepassing van afspraken en contractvoorwaarden die van deze algemene voorwaarden afwijken wordt uitgesloten, behoudens wanneer dit voorafgaandelijk, schriftelijk en uitdrukkelijk door Vrouyr aanvaard is.

Artikel 2: Prijs
Alle vermelde prijzen zijn uitgedrukt in EURO.

Alle prijzen zijn inclusief BTW en alle andere verplicht door de Klant te dragen taksen of belastingen in de mate dat deze op voorhand gekend zijn door Vrouyr. Indien de BTW, taksen of belastingen niet vooraf kunnen worden berekend, wordt dit uitdrukkelijk vermeld op het moment van het aanbod van het product of zal Vrouyr op het moment van het aanbod van het product de toe te passen berekeningswijze vermelden.

De leverings-, reservatie- of administratieve kosten die worden aangerekend, worden apart vermeld in de mate dat deze op voorhand gekend zijn door Vrouyr. Indien de leverings-, reservatie- of administratieve kosten niet vooraf kunnen worden berekend, wordt dit uitdrukkelijk vermeld op het moment van het aanbod van het product of zal Vrouyr op het moment van het aanbod van het product de toe te passen berekeningswijze vermelden.

De opgave van prijs slaat uitsluitend op de artikelen zoals het woordelijk wordt omschreven. Afbeeldingen zijn louter illustratief en decoratief en kunnen elementen bevatten die niet inbegrepen zijn in de prijs of afwijken van het artikel.

Artikel 3: Aanbod
Ondanks het feit dat de online catalogus en de webshop met de grootst mogelijke zorgvuldigheid worden samengesteld, is het toch mogelijk dat de aangeboden informatie onvolledig is, materiële fouten bevat, of niet up-to-date is. Aangezien Vrouyr enkel handgemaakte artikelen aanbiedt, zijn geen twee producten gelijk en kunnen specificaties van producten licht afwijken van wat in de webshop vermeld staat.

Vrouyr is wat de juistheid en volledigheid van de aangeboden informatie slechts gehouden tot een middelenverbintenis. Vrouyr is in geen geval aansprakelijk ingeval van manifeste materiële fouten.

Wanneer de Klant specifieke vragen of wensen heeft over bv. maten, kleur, beschikbaarheid, leveringstermijn of leveringswijze, verzoeken wij de Klant om vooraf contact op te nemen met Vrouyr via de bovenstaande contactgegevens.

Het aanbod geldt steeds zolang de voorraad strekt en kan te allen tijde worden aangepast of ingetrokken door Vrouyr. Vrouyr kan niet aansprakelijk gesteld worden voor het niet beschikbaar zijn van een product. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.

Vrouyr houdt zich steeds het recht voor om bestellingen te weigeren of te annuleren in de onderstaande gevallen:

Bij een ernstige tekortkoming van de Klant met betrekking tot bestellingen waarbij de Klant betrokken is Bij een vermoeden van rechtsmisbruik of kwade trouw van de Klant;
Bij uitputting van de voorraad of het niet langer beschikbaar zijn van een artikel;
Bij vaststelling van een ongeldig aanbod;
Bij overmacht.

Artikel 4: Procedure online aankopen
De Klant kan tijdens het surfen op de website en voorafgaand aan de betaling van de producten de bestelling te allen tijde annuleren of wijzigen.

Voordat de verkoopovereenkomst tussen Vrouyr en de Klant wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de Klant beschikbaar gesteld en dient de Klant deze algemene voorwaarden uitdrukkelijk aanvaarden.

De verkoopovereenkomst komt tot stand op het moment dat de Klant de bestelde producten op de webshop heeft betaald. De Klant heeft de keuze tussen de volgende betaalwijzen:

via kredietkaart
via bankkaart

De bestelling wordt na ontvangst van de betaling geleverd op een door de Klant gekozen adres in België of opgehaald door de klant bij Vrouyr.

Artikel 5: Levering en uitvoering van de overeenkomst
Tenzij uitdrukkelijk anders bepaald in de productinformatie op de webshop of anders overeengekomen met de Klant, worden de producten aan het door de Klant aangeduide adres geleverd binnen 10 werkdagen na ontvangst van betaling. De vermelde leveringsdatum is slechts indicatief en is afhankelijk van de leveringsdatum door de leveranciers van Vrouyr. Vrouyr kan niet verantwoordelijk worden gesteld voor een laattijdige levering van één van haar leveranciers. Indien de leveringsdatum dient te worden gewijzigd, wordt de Klant onverwijld gecontacteerd.

Tenzij uitdrukkelijk anders bepaald in de productinformatie op de webshop of anders overeengekomen met de Klant, worden de producten aan het door de Klant aangeduide adres geleverd door een door Vrouyr aangestelde vervoerder. De vervoerder biedt de producten op het door de Klant aangeduide adres aan tot aan de voordeur – gelijkvloers. De vervoerder kan bij de levering een identiteitsbewijs vragen. In geval een wederaanbieding nodig is omwille van de afwezigheid van de Klant, behoudt Vrouyr zicht het recht voor om de hierdoor veroorzaakte extra kosten aan te rekenen.

Artikelen besteld via deze webshop worden geleverd op het grondgebied België.

Betaalde artikelen dienen opgehaald te worden binnen een termijn van 4 weken na betaling. Indien de Klant nalaat om de artikelen op te halen binnen een tijdsspanne van 6 weken zal Vrouyr vrij kunnen beschikken over de niet opgehaalde artikelen.

Elke zichtbare beschadiging en/of kwalitatieve tekortkoming van een artikel of andere tekortkoming bij de levering, moeten door de Klant onverwijld worden gemeld aan Vrouyr.

Het risico wegens verlies of beschadiging gaat over op de Klant vanaf hij (of een door hem aangewezen derde partij, die niet de vervoerder is) de producten fysiek in ontvangst neemt. Het risico gaat echter al over op de Klant bij aanvang van het vervoer, wanneer de Klant zelf de vervoerder aanstelt.

Artikel 6: Eigendomsvoorbehoud
De geleverde artikelen blijven tot op het moment van gehele betaling door de Klant, de exclusieve eigendom van Vrouyr.
De Klant verbindt er zich toe zo nodig derden op het eigendomsvoorbehoud van Vrouyr te wijzen, bv. aan eenieder die op de nog niet geheel betaalde artikelen beslag zou komen leggen.

Artikel 7: Herroepingsrecht
De bepalingen van dit artikel gelden enkel voor Klanten die in hun hoedanigheid van consument artikelen online aankopen bij Vrouyr.

De Klant heeft het recht om voorafgaand aan de levering van de producten en binnen een termijn van 14 kalenderdagen na de levering van de producten zonder opgave van redenen de overeenkomst te herroepen.

Om het herroepingsrecht uit te oefenen, moet de Klant Vrouyr via een ondubbelzinnige verklaring (schriftelijk per post of per e-mail) op de hoogte stellen van zijn beslissing de overeenkomst te herroepen. De Klant kan hiervoor gebruikmaken van het bijgevoegde modelformulier voor herroeping, maar is hiertoe niet verplicht.

Om de herroepingstermijn na te leven moet de Klant zijn mededeling betreffende zijn uitoefening van het herroepingsrecht verzenden voordat de herroepingstermijn is verstreken.

De Klant moet de producten die reeds geleverd waren onverwijld, doch in ieder geval niet later dan 14 kalenderdagen na de dag waarop hij zijn beslissing om de overeenkomst te herroepen aan Vrouyr heeft meegedeeld, terugzenden of overhandigen op de zetel van Vrouyr. De Klant is op tijd als hij de producten terugstuurt voordat de termijn van 14 kalenderdagen is verstreken. De directe kosten van het terugzenden van de producten komen voor rekening van de Klant.

Indien het teruggezonden product op een of andere manier in waarde verminderd is door gebruik of beschadiging, behoudt Vrouyr zich het recht voor om de Klant aansprakelijk te stellen en schadevergoeding of compensatie op de terugbetaling te eisen voor elke waardevermindering van de producten die het gevolg is van het (verkeerd) gebruik van de producten door de Klant dat verder gaat dan nodig is om de aard, de kenmerken en de werking van de producten vast te stellen (zie in dit opzicht ook artikel 9: gebruiksinstructies en kenmerken producten).

Enkel artikelen die zich in de originele verpakking bevinden, samen met alle toebehoren en factuur of aankoopbewijs kunnen worden teruggenomen.

Wanneer het product nog niet geleverd was aan de Klant, betaalt Vrouyr binnen 14 kalenderdagen na ontvangst van de ondubbelzinnige verklaring van herroeping de Klant terug op dezelfde rekening als diegene waarmee deze de oorspronkelijke transactie heeft verricht. Wanneer het product reeds geleverd was aan de Klant, betaalt Vrouyr binnen 14 kalenderdagen na ontvangst van de teruggezonden producten de Klant terug op dezelfde rekening als diegene waarmee deze de oorspronkelijke transactie heeft verricht. Er zullen de Klant voor zulke terugbetalingen geen kosten in rekening worden gebracht.

De Klant kan het herroepingsrecht niet uitoefenen voor:

de levering van volgens specificaties van de Klant vervaardigde producten, of die duidelijk voor een specifieke persoon bestemd zijn;
de levering van producten die na levering onherroepelijk vermengd zijn met andere producten;
de levering van producten die verkocht zijn tijdens een openbare veiling.

Artikel 8: Garantie
De bepalingen van dit artikel gelden enkel voor Klanten die in hun hoedanigheid van consument artikelen online aankopen bij Vrouyr.

Voor consumenten geldt de wettelijke garantie van 2 jaar. Deze garantie dekt enkel een gebrek aan overeenstemming dat reeds bestond bij de levering van de producten. Gedurende deze 2 jaar verbindt Vrouyr ertoe het product kosteloos te vervangen met een gelijkaardig product, te herstellen of indien noch een herstelling noch een garantie redelijkerwijze mogelijk zijn, de gedeeltelijke of gehele terugbetaling van het product, zoals passend blijkt te zijn.

Defecten die zich manifesteren na een periode van 6 maanden na de levering, worden niet geacht aanwezig te zijn op het ogenblik van de levering, behoudens tegenbewijs van de Klant.

Om een beroep te doen op een garantie, moet de Klant het aankoopbewijs, het kasticket of de factuur kunnen voorleggen. De garantie is niet overdraagbaar. Elk gebrek dient binnen de 2 maanden na vaststelling, binnen de garantieperiode (schriftelijk per post of per e-mail), ervan te worden gemeld. Nadien vervalt elk recht op herstelling, vervanging of terugbetaling. De terugzending en terugbetaling van producten die onder de garantie vallen, gebeurt conform de bepalingen in artikel 7 van deze algemene voorwaarden.

De garantie is nooit van toepassing op defecten die ontstaan ten gevolge van ongelukken, verergering van de toestand door nalatigheid, valpartijen, gebruik van het artikel in strijd met het doel waarvoor het ontworpen werd, het niet naleven van de gebruiksinstructies of handleiding, aanpassingen of wijzigingen aan het toestel, hardhandig gebruik, foutieve montage, slecht onderhoud, abnormaal, commercieel of incorrect gebruik (zie in dit opzicht ook artikel 10: gebruiksinstructies). De garantie is bovendien nooit van toepassing bij de aankoop van tweedehandsproducten.

Artikel 9: Gebruiksinstructies en kenmerken producten
Gelet op de specifieke aard van de goederen die Vrouyr aanbiedt, dient de Klant zich op voorhand goed te informeren over de kenmerken van de producten, wil zij aanspraak kunnen maken op het garantierecht. Minstens dienen de onderstaande elementen in aanmerking te worden genomen.

Gelet op de specifieke aard van de goederen die Vrouyr aanbiedt, dient de Klant bovendien ten allen tijde de gebruiksinstructies correct na te leven, wil zij aanspraak kunnen maken op een (volledige) terugbetaling, herstel of vervanging in het kader van het herroepingsrecht en de garantie. Minstens dienen de onderstaande elementen in aanmerking te worden genomen.

Alle producten:

Gelet op het feit dat Vrouyr enkel handgemaakte artikelen aanbiedt, zijn geen twee producten gelijk en kunnen specificaties van producten licht afwijken van wat in de webshop vermeld staat.
Sommige producten zijn reeds gebruikt of zijn ouder en dus kunnen mogelijk in een niet perfecte staat verkeren.

Aardewerk:

Het gebruik van de vaatwasser is niet toegelaten.

Textiel:

Vrouyr kan niet garant staan voor verkleuring van welk textiel dan ook. Textiel is steeds UV gevoelig.
Het gebruik van een wasmachine/droogmachine/strijkijzer voor welk textiel dan ook is niet toegelaten.

Tapijt:

Tapijten zijn allemaal handgemaakt. Geen van de tapijten zijn dan ook recht. Lichte afwijkingen van afmeting zoals aangeduid op de website, zijn mogelijk.
Beschadiging die na enige tijd zou optreden door (normaal) gebruik, is normaal.
Voor meer info over de correcte wijze van herstelling en reiniging van tapijten dient Vrouyr op voorhand door de Klant te worden gecontacteerd op bovenstaande contactgegevens.
Bij bestellingen op maat zijn afwijkingen qua kleur en afmeting mogelijk.

Kledij:

Bij het wassen van kledij is verkleuring en krimping mogelijk

Decoratief textiel:

Prijzen zoals aangegeven op de webshop gelden voor de textielen zoals ze getoond worden. Extra behandelingen of aanpassingen kunnen aanleiding geven tot bijkomende kosten die op voorhand gecommuniceerd zullen worden.
Sommige textielen verkeren mogelijk niet in perfecte staat daar het kan gaan om reeds gebruikte of oude textielen.

Artikel 10: Klantendienst
De klantendienst van Vrouyr is bereikbaar op de hierboven vermelde contactgegevens. Eventuele klachten kunnen aan de klantendienst gericht worden.

Artikel 11: Privacy
Vrouyr respecteert de Belgische wet van 8 december 1992 met betrekking tot de bescherming van het privéleven in de verwerking van de persoonlijke gegevens.

De door u meegedeelde persoonsgegevens zullen enkel gebruikt worden om de Klanten op de hoogte te houden van evenementen, of voor het versturen van uitnodigingen. De persoonsgegevens worden nergens anders gedeeld en worden voor geen andere doeleinden gebruikt noch zullen ze worden doorgegeven, verhuurd of verkocht aan derden. U kan zich kosteloos verzetten tegen het voormeld gebruik van uw gegevens. Hiertoe kan U zich steeds richten tot Vrouyr op de bovenvermelde contactgegevens.

U beschikt over een wettelijk recht op inzage en eventuele correctie van uw persoonsgegevens. Mits bewijs van identiteit (kopie identiteitskaart) kunt u via een schriftelijke, gedateerde en ondertekende aanvraag aan Vrouyr op de bovenstaande contactgegevens gratis de schriftelijke mededeling bekomen van uw persoonsgegevens. Indien nodig kunt u ook vragen de gegevens te corrigeren die onjuist, niet volledig of niet pertinent zouden zijn.

De klant is zelf verantwoordelijk voor het vertrouwelijk houden van zijn logingegevens en het gebruik van zijn paswoord. Uw paswoord wordt gecodeerd opgeslagen, Vrouyr heeft dus geen toegang tot uw paswoord.

Vrouyr houdt online (anonieme) bezoekersstatistieken bij om te kunnen bekijken welke pagina’s van de internetsite in welke mate bezocht worden.

Artikel 12: Gebruik van cookies
Tijdens een bezoek aan de site kunnen 'cookies' op de harde schijf van uw computer geplaatst worden. Een cookie is een tekstbestand dat door de server van een website in de browser van uw computer of op uw mobiel apparaat geplaatst wordt wanneer u een website raadpleegt. Cookies kunnen niet worden gebruikt om personen te identificeren, een cookie kan slechts een machine identificeren.

U kan uw internetbrowser zodanig instellen dat cookies niet worden geaccepteerd, dat u een waarschuwing ontvangt wanneer een cookie geïnstalleerd wordt of dat de cookies nadien van uw harde schijf worden verwijderd. Dit kan u doen via de instellingen van uw browser (via de help-functie). Hou er hierbij wel rekening mee dat bepaalde grafische elementen niet correct kunnen verschijnen, of dat u bepaalde applicaties niet zal kunnen gebruiken.

Artikel 13: Aantasting geldigheid - niet-verzaking
Indien een bepaling van deze algemene voorwaarden ongeldig, onwettig of nietig wordt verklaard, zal dit op geen enkele wijze de geldigheid, de wettigheid en de toepasbaarheid van de andere bepalingen aantasten.

Het nalaten op gelijk welk moment door Vrouyr om één van de in deze algemene voorwaarden opgesomde rechten af te dwingen, of gelijk welk recht hiervan uit te oefenen, zal nooit gezien worden als een verzaking aan zulke bepaling en zal nooit de geldigheid van deze rechten aantasten.

Artikel 14: Wijziging voorwaarden
Deze algemene voorwaarden worden eventueel aangevuld door afspraken in de verkoopovereenkomst. Ingeval van tegenstrijdigheid, primeert de verkoopovereenkomst

Artikel 15: Bewijs

De Klant aanvaardt dat elektronische communicaties en back-ups als bewijsvoering kunnen dienen.

Artikel 16: Toepasselijk recht – Geschillen
Het Belgisch recht is van toepassing, met uitzondering van de bepalingen van internationaal privaatrecht inzake toepasselijk recht.

Bij een geschil met consumenten zijn de rechtbanken van de woonplaats van de Klant bevoegd bij gerechtelijke geschillen.

Bij een geschil met handelaars zijn de rechtbanken van de maatschappelijke zetel van Vrouyr bevoegd bij gerechtelijke geschillen.
